Andrea Rosal, the daughter of the late Communist Party of the Philippines spokesperson, walked out of her detention cell in Camp Bagong Diwa in Taguig City at around 8:30 p.m. today, following the issuance of her release order by the Mauban Regional Trial Court Branch 64 this morning.
“Her freedom is due to the resolute legal battle and campaign, no thanks to this government which inhumanly refuses or ignores pleas for compassion and humanitarian cries,” the National Union of Peoples’ Lawyers said in a statement.
Rosal, the daughter of the late CPP spokesperson Gregorio “Ka Roger” Rosal, was seven months pregnant when she was arrested on March 27, 2014 in Caloocan City. She faced a murder charge in the Mauban court, and kidnapping charges in a Pasig court. While still in detention, she gave birth to daughter Diona Andrea, who died after two days. Rosal blamed government neglect and adverse conditions in jail.
Last year, a Pasig court dismissed the the kidnapping charges filed against Rosal due to lack of evidence.
The NUPL, Rosal’s lawyers, said that while she was able to prove the allegations as false, the “malicious persecution has lost her precious time, cost her a child, and brought deep anguish to her family.”
“Would she have been subject to all this had she been moneyed and influential? Would she have been arrested had she been someone else’s daughter? It is indeed cruel injustice to incarcerate her on mere filial affiliation,” the NUPL added.
The group said those responsible for Rosal’s misery “must be made to account and restitute the irreparable damage to her and her dead baby daughter. Else, justice will come at the right time.”
Rosal is set to hold a press conference tomorrow at 1 p.m. in Quezon City.
